1. Provider and scope

These terms of sale apply to leisure hires offered to consumers by CANNES STAND-UP PADDLE LOCATION (C.S.P. LOCATION), trading as Kayak & Paddle Évasion, at Pointe Croisette (Palm Beach), Cannes. French limited liability company (SARL), share capital €1,980, Cannes Trade and Companies Register 793 491 861, VAT FR50 793 491 861. They cover services presented on the website and available online bookings. Special or instructor-led services may be covered by a quotation specifying their features and price before any commitment.

2. Activities and features

The selected option specifies the activity, duration, date, participants and extras. Online bookings cover kayaks, individual paddleboards and Duo paddleboards. Pedal boats are hired directly at the base. Activities are offered during the season, from 1 May to 15 October, subject to availability and safety conditions.

Kayaks may be hired with or without an instructor depending on the chosen service. Online kayak hires allow flexible departures from 9 am within the agreed hire period. A half-day lasts four hours. Online paddleboard and Duo bookings show departure and return times in the summary. Each Duo board is for two people.

Route limits, navigation conditions and return times are explained before departure. Paddleboarding is along the Cannes coastline: crossing to the Lérins Islands by paddleboard is prohibited.

3. Prices and extras

Prices are in euros and include all taxes. The applicable price is the one shown before confirmation. The total includes the chosen option, number of participants and extras. The confirmed amount cannot be increased without the customer agreeing to a change in the service.

For kayak bookings of five or more participants, a €5 discount per person applies to half-day, full-day, sunset and full-day with sunset options. It does not apply to one-hour or two-hour hires. Individual paddleboards are priced per board for one person; Duo boards are priced per board for two people.

Optional mask and snorkel hire costs €5 per equipped person. Prices and extras for services hired directly at the base are communicated before payment.

4. Booking and confirmation

The customer selects the option, date, participants and extras, then provides contact details. Information can be corrected before confirmation. The customer confirms that all participants can swim, acknowledges the briefing at the base and accepts these terms through an unticked checkbox.

The booking is concluded when its saving is confirmed on screen with a reference and summary. An e-mail confirmation is also sent to the supplied address. If no e-mail arrives, keep the summary and contact the base: missing e-mail does not cancel a booking already confirmed on screen.

The summary and terms can be saved or printed. The terms accepted at the time of booking remain applicable to that booking.

5. Payment and no deposit

No advance payment or online payment is required. The price is paid at the base by card or cash before equipment is provided. Confirming a booking commits the customer to paying for the service if they attend, subject to the free cancellation policy.

No security deposit is required.

6. Customer cancellation or changes

Customers may cancel at any time before the service begins, free of charge. Please inform the base by phone on +33 7 69 91 57 01 or by e-mail at contact@kayak-paddle-evasion.fr, quoting the booking reference or name and date.

Requests to change the date, option or number of participants are subject to availability. Any revised price is communicated for agreement before the change.

7. Weather, safety and cancellation by the base

The base may postpone or cancel an activity if weather, navigation conditions or another situation prevent safe operation. No payment is required for a service cancelled by the base before it begins. Any amount already paid for that unperformed service is refunded; rescheduling cannot be imposed on the customer.

The base may refuse departure if a participant cannot swim or safety instructions cannot be followed. Changes to the service must be explained before the customer agrees.

8. Participation and equipment

All participants must be able to swim. Before departure, the team briefs participants on equipment, basic technique, routes and safety. Participants must follow instructions, use the safety equipment provided and remain within the stated navigation area.

Report equipment defects when collecting it and return equipment and accessories at the agreed time. Notify the base of problems or delays. Liability for loss or damage depends on the circumstances and applicable law and must be supported by evidence; normal wear is not damage attributable to the customer.

9. Statutory withdrawal

Leisure services booked for a specified date or period are excluded from the statutory fourteen-day withdrawal right under Article L.221-28(12) of the French Consumer Code. This does not limit the right to cancel free of charge at any time before the service under section 6.

10. Liability and customer rights

Each party is responsible for its obligations under applicable law. These terms do not exclude consumer rights, guarantees or liability that cannot legally be excluded. They do not impose a general waiver of claims for accidents or damage.

11. Complaints and mediation

For complaints, write to contact@kayak-paddle-evasion.fr or the registered office, stating the date, booking reference and problem.

Consumers have the right to use a consumer mediator free of charge to resolve a dispute after first complaining to the provider. C.S.P. LOCATION has not yet designated a consumer mediator. Contact details and the referral procedure will be added after joining a mediation scheme. This obligation remains outstanding.

12. Data, governing law and records

Contact details are used to manage bookings, contact customers and send confirmations. The accepted terms and acceptance date are stored with the booking. Data-related requests may be sent to contact@kayak-paddle-evasion.fr.

French law applies, subject to mandatory consumer protection provisions. Competent courts are determined by applicable legal rules; consumers are not required to bring disputes exclusively in Cannes. Later changes to these terms do not retrospectively change existing bookings.
